Terms and Conditions

1. Preamble

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Nakashi, a simplified single-member company (SASU) with a capital of 1,000 euros, registered with the Bobigny Trade and Companies Register under the SIRET number 93112686600017, and any individual or legal entity wishing to make a purchase via the website www.nakashi.fr, hereinafter referred to as "the Customer." By placing an order on the website, the Customer unreservedly accepts these terms and conditions.

2. Products and Services

Nakashi offers for sale sports and martial arts items, such as kimonos, t-shirts, and protective gear. The products are described and presented with the utmost accuracy. However, if errors or omissions occur in this presentation, Nakashi cannot be held liable. Product offers are valid while stocks last.

3. Orders

Orders are placed exclusively on our website www.nakashi.fr. The Customer can choose to create an account or place an order as a guest. The order is considered final after payment has been confirmed. Nakashi reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute concerning the payment of a previous order.

4. Prices and Payment

Prices are indicated in euros, inclusive of all taxes (VAT included), and include the VAT applicable on the day of the order. Nakashi reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time of order confirmation. Payment is made by credit card or via PayPal and is required immediately upon ordering.

5. Delivery

Nakashi delivers its products internationally. Delivery costs are borne by the Customer and vary depending on the destination country. Standard delivery times are 3 to 5 business days for France, and up to 14 days for international shipments. Nakashi cannot be held responsible for delivery delays attributable to the carrier. In case of delay or loss of the package, Nakashi commits to opening a dispute with the carrier.

6. Right of Withdrawal and Returns

In accordance with current legislation, the Customer has 14 days from the receipt of their items to exercise their right of withdrawal, without having to provide reasons or pay penalties, except for return shipping costs, which are borne by the Customer. Returned products must be unworn, unwashed, undamaged, and in their original packaging. Once the return is validated, the Customer will be refunded within 10 business days.

7. Warranty and After-Sales Service

Products sold on the Nakashi website are covered by the legal warranty of conformity and the legal warranty against hidden defects. In case a defect is found on a product, the Customer must contact customer service by email at contact@nakashi.fr to arrange a return. No additional commercial warranty is offered by Nakashi.

8. Liability

Nakashi strives to provide the most accurate information possible. However, Nakashi cannot be held responsible for errors, omissions, or inaccuracies in the information on the website. Nakashi's liability cannot be engaged for any damage resulting from the use of the internet, such as data loss, intrusion, virus, service disruption, or other involuntary issues.

9. Intellectual Property

All elements of the Nakashi website (texts, images, videos, logos, trademarks, etc.) are protected by copyright, trademarks, or patents. They are the exclusive property of Nakashi or its partners. Any reproduction, modification, publication, or adaptation of all or part of the elements on the site is prohibited without prior written authorization from Nakashi.

10. Personal Data

Nakashi is committed to protecting the personal data of its customers. The information collected is subject to computer processing intended to manage orders, deliver products, and communicate with customers. In accordance with the GDPR, the Customer has the right to access, rectify, and delete data concerning them, which they can exercise by contacting Nakashi by email at contact@nakashi.fr.

11. Disputes and Applicable Law

These GTC are governed by French law. In case of a dispute, an amicable solution will be sought before any legal action. Failing that, the competent court will be the court of Bobigny (France).
